These Terms & Conditions (“Terms”) govern your access to and use of the KAM Raceway streaming service, website, and any related content or features (collectively, the “Service”). The Service is operated by KAM Raceway and/or X-Stream Sports (collectively, “We,” “Us,” or “Our”).

BY ACCESSING OR USING THE SERVICE, YOU AGREE TO THESE TERMS. If you do not agree, do not access or use the Service.

1) Eligibility & Account Responsibility

• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You agree to provide accurate account information and keep it updated.
• You agree not to share your account, resell access, or allow others to use your account.
• We may suspend or terminate accounts for suspected abuse, sharing, or violations of these Terms.

2) Subscriptions, Billing, and No Refunds

ALL SALES ARE FINAL. To the maximum extent permitted by law, NO REFUNDS, NO CREDITS, and NO PRORATIONS will be provided for any reason, including (without limitation) service interruptions, user error, inability to access the Service, dissatisfaction, unused time, device issues, third-party outages, Internet issues, or any other circumstance.

• Subscription fees (if any) are billed according to the plan presented at checkout.
• You are responsible for any taxes or fees imposed by your jurisdiction.
• Chargebacks or payment disputes may result in immediate suspension/termination of access.

3) Service Availability; Interruptions; No Guarantee

The Service may be affected by factors outside Our control, including (without limitation) Internet outages, bandwidth constraints, power failures, device limitations, browser/app issues, payment processor outages, hosting/CDN failures, scheduled maintenance, third-party platform issues, or force majeure events.

WE DO NOT GUARANTEE uninterrupted, timely, secure, or error-free operation of the Service, or that any stream will be available at any particular time. Content, schedules, and availability may change without notice.

4) Acceptable Use

• No scraping, recording for redistribution, rebroadcasting, mirroring, or circumvention of paywall/security controls.
• No attempts to access accounts, systems, or data you do not have permission to access.
• No interference with the Service (including DDoS, automated logins, credential stuffing, or abusive traffic).
• We may investigate and take action at Our discretion, including suspension, termination, or legal referral.

5) Intellectual Property

The Service and its content (including streams, graphics, logos, text, and software) are owned by Us and/or Our licensors and are protected by applicable intellectual property laws. You receive a limited, revocable, non-transferable license to access the Service for personal, non-commercial viewing only, subject to these Terms.

6) Disclaimers (AS-IS / AS-AVAILABLE)

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.

To the maximum extent permitted by law, We disclaim all warranties, express or implied, including (without limitation) implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will meet your requirements, be compatible with your device, or that defects will be corrected.

7) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL KAM RACEWAY OR X-STREAM SPORTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

This includes (without limitation) loss of profits, loss of data, loss of goodwill, service interruption, device failure, Internet/provider issues, third-party failures, or inability to access the Service, even if We have been advised of the possibility of such damages.

To the maximum extent permitted by law, Our total liability for any claim arising out of or relating to the Service will not exceed the greater of: (a) the amount you paid to Us for the Service in the 30 days prior to the event giving rise to the claim, or (b) $25.00.

8) Release & Assumption of Risk

You understand and agree that access to streaming content may be impacted by technical limitations and events outside Our control. You assume all risks associated with your use of the Service. To the maximum extent permitted by law, you release and hold harmless KAM Raceway and X-Stream Sports from any claims arising from your use of, inability to use, or reliance on the Service.

9) Indemnification

You agree to defend, indemnify, and hold harmless KAM Raceway and X-Stream Sports, and their owners, officers, employees, contractors, and agents, from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any law or rights of a third party; or (d) your account sharing or misuse.

10) Termination

We may suspend or terminate your access at any time, with or without notice, if We believe you violated these Terms or for any lawful reason. Upon termination, your right to access the Service will cease immediately. No refunds will be provided upon suspension or termination.

11) Changes to the Service or Terms

We may modify the Service and/or these Terms at any time. Changes are effective when posted. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

12) Governing Law; Venue

These Terms are governed by the laws of Nebraska, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Adams County, Nebraska, and you consent to personal jurisdiction and venue there.

13) Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
